Dear Mr. Reed:
Roland Corporation produces a well-known line of "BOSS" effects pedals, and distributes them in the United States exclusively through Roland Corporation U.S. Various products in the "BOSS" line can be seen at Roland's website at www.rolandus.com.
It has come to Roland's attention that you are offering for sale on your website (at www.manyetas.com/creed/crunch.html) an overdrive/distortion effects unit -- or perhaps a software download thereof -- bearing the "CRUNCH" mark. A copy of a page from your website showing this product is attached for your reference.
The picture of the "CRUNCH" product appears to have been created by copying a photograph of one of Roland's "BOSS" pedals (it appears to be the BOSS CH-1 Super Chorus pedal), removing the "BOSS" trademark, and replacing it with your own "CRUNCH" mark. Roland has never given permission to use its product photographs in this manner, and your creation and use of this photograph constitute copyright infringement and unfair competition under Section 43(a) of the United States Trademark Act.
Therefore, Roland hereby demands that you immediately cease and desist from further use of this photograph on the Internet or otherwise and that you confirm the same in writing to the undersigned. If you do not promptly agree to do so, Roland will be forced to consider further action to protect its rights.
Nothing contained herein shall constitute a waiver by Roland of any rights or remedies, all of which are expressly reserved.
